ProbateProbate is a process by which property is transferred when a person dies. If there is a will, it is filed in court so that it can be determined if the will is valid. The court appoints an executor of the will or a personal representative of the estate to manage distribution of the estate, pay bills, and defend against any claims. The process may be supervised by the court. It is intended to protect everyone who might have an interest in the property, including beneficiaries, heirs, creditors, and taxing authorities. Assets subject to probate are those which do not pass directly to others through a community property agreement, a right of survivorship, a trust, as insurance proceeds, or in some other manner. A probate proceeding requires legal documents to be prepared and filed, and one or more court hearings may be necessary. However, under Washington law, in many cases probate can be completed with very little court involvement. When a loved one dies, it can be difficult to deal with the time and complexities of a probate proceeding.
